Long John Silver’s (LJS), LLC is the franchisor. LJS restaurants promptly serve a limited menu that specializes in fish, seafood, chicken. Restaurants have dine-in, take-out, some of them also have drive-thru service. The restaurant must be built following the specifications of the franchisor and operated under LJS standards. The franchisor offers traditional, co-brand, and express restaurants.
The franchisor certifies franchisee-owned training units for traditional restaurants and express restaurants at locations at its discretion. The franchisor determines the franchisee’s employees for training. Currently, training is held at franchisee-owned restaurants and at meeting facilities (hotels and/or convention centers) all over the U.S. Upon request the franchisor provides for co-brand restaurants a pre-opening management training program and other training at the same locations and the periods as for other LJS franchisees.
The franchisor will designate a time and location for the pre-opening management training program. Managers must be certified 30 days before opening by completing training at a certified LJS training restaurant (four managers for a traditional restaurant, one manager for an express restaurant, and five managers for a co-brand restaurant).
If the franchisee or restaurant leader are not managers, they must also complete training. for the franchisee’s executive, managerial, supervisory, and other employees that the franchisor will appoint, the franchisor may offer and require to attend refresher courses and retraining programs. Additional training may be offered or required for restaurant managers and above store managers.
Territory Granted: Traditional restaurant franchisees have the right to operate one traditional restaurant at a specified address. The franchisor determines the territory for traditional restaurants at its own discretion based on the expected number of visitors and other factors. Typically the territory for a traditional restaurant is a one and one-half mile radius from the location.
Generally, the territory for traditional restaurants in a convenience and gas store is a one-mile radius from the site. Except as otherwise provided in FDD, for co-branded restaurants, the franchisor grants not to operate or sell to others the right to operate the restaurant in an area equal to the smaller of the circle formed by a radius of 1.5 miles measured from the center of the location or circle, measured from the center of a location that has 30,000 people living and/or working. Typically, the franchisor does not grant any protected territory for express restaurants.
Obligations and Restrictions: The franchisor strongly recommends franchisees personally participate in the direct operation of their restaurant. If franchisees will not personally supervise restaurant operations or they are legal entities (corporation, limited liability company, or partnership) they must hire at least one manager for on-premises supervision.
The manager and other employees designated by the franchisor must attend and complete LJS’s training programs. At the restaurant, Franchisees may sell only food and beverage products that are approved by the franchisor in the operations manual and meet the standards contained in the operations manual.
Term of Agreement and Renewal: Generally, the length of the initial franchise agreement is with two five-year options or concurrent with lease terms not to exceed a total of 30 years. Terms of Renewal are subject to the franchisee's good reputation and compliance with the renewal conditions.
Financial Assistance: The franchisor does not offer, directly or indirectly, any arrangements for financing the franchisee’s initial investment or the continuing operation of the Long John Silver’s business. The franchisor does not guarantee a franchisee’s note, lease or obligation.
